TERMS OF SERVICE

OVERVIEW

This website is operated by Baby Beaks Redland Bay. Throughout these Terms of Service, “Baby Beaks”, “we”, “us” and “our” refer to Baby Beaks Redland Bay.

These Terms apply to your use of our website and your purchase, reservation or surrender of a bird, product or service from Baby Beaks. By accessing our website, placing an order, joining a waitlist, paying a deposit or purchasing a bird or product, you agree to these Terms of Service and our Refund, Return and Surrender Policy.

You must be at least 18 years old to reserve or purchase a bird. If a bird is intended for a child, the responsible adult remains the legal purchaser and is responsible for the bird’s care and welfare.

ANIMAL WELFARE

The health and lifelong welfare of every bird is our highest priority.

Customers must provide appropriate housing, nutrition, enrichment, supervision, social interaction and veterinary care. Customers are responsible for researching the chosen species and ensuring it is suitable for their home, experience, lifestyle and financial circumstances.

Baby Beaks reserves the right to refuse or cancel a sale before the bird leaves our care where we reasonably believe the proposed home is unsuitable, information has been misrepresented or completing the sale may place the bird’s welfare at risk.

If we cancel a sale, any payment will be handled fairly and in accordance with Australian Consumer Law. Where cancellation results from false information, failure to comply with an agreement or another customer breach, we may retain reasonable costs where permitted by law.

BIRD LISTINGS AND AVAILABILITY

All birds are subject to availability. Adding a bird to your cart, joining a waitlist, sending an enquiry or expressing interest does not reserve that bird.

A bird is only reserved once Baby Beaks has accepted the reservation and received the required deposit.

We do not hold birds while customers wait for a preferred colour, mutation or DNA result unless we have expressly agreed to do so. Birds are placed in suitable homes during the appropriate rehoming period.

Photographs and videos are provided as accurately as possible. Colour may appear different because of lighting, screens, age, feather development or moulting. Natural development may also cause a bird’s appearance to change.

WAITLISTS

Joining a waitlist does not guarantee:

• That a particular species, colour, mutation or sex will become available
• A specific position where customers ahead of you have priority
• A particular breeding result
• A collection date or time frame
• That Baby Beaks will accept a future sale

We will contact waitlisted customers when a potentially suitable bird becomes available. Customers must respond within the time specified in our message or the opportunity may be offered to the next person.

DEPOSITS AND PAYMENT

Where a bird listing displays a “deposit amount”, the amount charged through the website is a deposit only and is not the bird’s full purchase price.

The remaining balance must be paid by the agreed date and before or at collection, as directed by Baby Beaks. Products and supplies purchased through the website are charged at their displayed full price unless clearly stated otherwise.

Deposits secure a particular bird and remove that bird from availability to other potential homes. Deposits are not refundable for change of mind or customer cancellation, except where required by law.

If Baby Beaks is unable to supply the reserved bird, the amount paid will be refunded unless the customer agrees to transfer it to another available bird.

All prices are displayed in Australian dollars unless otherwise stated.

WEANING AND COLLECTION

Baby birds will not leave our care until Baby Beaks is satisfied that they are fully weaned, independently eating and ready to transition to their new home.

Estimated weaning and collection dates are guides only. Every bird develops at a different rate, and we will not rush the weaning process to meet a preferred date.

Customers must wait until Baby Beaks personally confirms that their bird is ready and a collection appointment has been arranged.

An automated Shopify order confirmation, pickup notification or other system-generated email does not mean that a bird is ready for collection. Customers must not attend the property without a confirmed appointment.

Failure to collect a bird within the agreed period, without arranging an extension, may be treated as a customer cancellation. Any additional boarding or care arrangements must be approved in advance and may incur a reasonable fee where disclosed and agreed.

APPOINTMENTS AND PROPERTY ACCESS

Baby Beaks operates by appointment only and is not an open-access pet shop.

Customers and visitors must not attend the property without prior confirmation. Appointment times must be respected due to feeding schedules, animal care requirements and family privacy.

We may end or refuse an appointment where a person behaves aggressively, abusively, disrespectfully or in a way that causes distress or risk to any person or animal.

PERSONAL UPDATES

Customers may be invited to contact our official Facebook page after placing their order so that personal updates can be provided.

Because Baby Beaks may be hand-raising many birds at one time, updates are provided according to our announced schedule. Daily photographs, videos or individual updates are not guaranteed.

NATURAL BEHAVIOUR AND TEMPERAMENT

Birds are living animals with individual personalities. Although our babies are lovingly hand-raised and socialised, we cannot guarantee that a bird will:

• Bond with a particular person
• Remain continuously tame without ongoing handling
• Speak or learn particular words
• Behave in a particular way
• Get along with children, other birds or household pets
• Remain quiet or free from biting, bluffing, hormonal or territorial behaviour

Customers are responsible for maintaining appropriate training, socialisation and care after collection.

A bird’s natural noise, mess, personality, bluffing, biting, hormonal behaviour or failure to bond as expected does not constitute grounds for a change-of-mind refund.

DNA SEXING

Where DNA sexing is offered, testing may be performed by an independent laboratory. Any sex information is based on the result supplied to Baby Beaks.

Estimated sex based on appearance, behaviour or breeder observation is not a DNA guarantee unless expressly stated in writing.

If a confirmed DNA result is later shown to be incorrect, please contact Baby Beaks with supporting documentation so the matter can be assessed in accordance with Australian Consumer Law.

HEALTH AND VETERINARY CARE

Customers should contact Baby Beaks as soon as possible if they have a genuine concern about a bird’s health following collection.

We may request an examination and written report from a qualified avian veterinarian to help determine the cause, timing and appropriate response. Customers must not delay urgent veterinary treatment while waiting for a response from Baby Beaks.

After collection, customers are responsible for protecting the bird from household hazards, toxins, unsafe foods, unsuitable temperatures, other animals, accidents and infectious exposure.

Baby Beaks cannot guarantee that a living animal will never develop an illness or medical condition in the future. However, nothing in these Terms excludes any rights or remedies available under Australian Consumer Law.

DIET AND CARE INFORMATION

Care information provided by Baby Beaks is general guidance and does not replace advice from a qualified avian veterinarian.

Customers are responsible for following appropriate feeding, hygiene and husbandry practices. Any dietary transition should be gradual and suitable for the individual bird.

PRODUCTS AND SUPPLEMENTS

Customers must read and follow all product labels, dosage instructions, storage requirements and safety warnings.

Veterinary products, supplements and treatments should be used only as directed. Customers should seek advice from a qualified avian veterinarian where a bird is unwell, taking medication or has an existing health condition.

Information on our website or social media is not veterinary diagnosis or treatment advice.

FREIGHT AND THIRD-PARTY PROVIDERS

Where freight is available, it may be arranged through an independent bird-transport provider. Freight availability, routes, timing, costs and conditions are determined by the provider.

Customers may be required to communicate with and pay the freight provider directly. Any separate agreement between the customer and freight provider is subject to that provider’s terms.

Baby Beaks will take reasonable care when preparing a bird for approved transport. Nothing in this clause limits any responsibility or consumer right that cannot legally be excluded.

REFUNDS, RETURNS AND EXCHANGES

Our Refund, Return and Surrender Policy forms part of these Terms.

Because birds are living animals, Baby Beaks does not offer refunds, returns or exchanges for change of mind, subject to Australian Consumer Law.

This includes changes involving housing, finances, allergies, family circumstances, time commitments, noise, mess, natural behaviour, bonding expectations or compatibility with other pets.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.

SURRENDERS

In exceptional circumstances, Baby Beaks may agree to accept a bird as a surrender to protect its welfare and assist with finding a suitable new home.

All surrenders require prior approval and are considered individually. Acceptance depends on available space, the bird’s health, behaviour and other relevant circumstances.

A surrender is not a return, refund, exchange or buy-back arrangement. No payment, refund, store credit or compensation will be provided for a surrendered bird.

The surrendering person must disclose all known medical conditions, behaviour concerns and relevant history honestly.

CUSTOMER INFORMATION

Customers must provide accurate contact, billing and order information. Baby Beaks is not responsible for delays or missed communications caused by incorrect or outdated information supplied by the customer.

Customers must notify us promptly if their contact information changes while a bird remains in our care.

WEBSITE INFORMATION AND ERRORS

We take reasonable care to ensure that website information, availability and pricing are accurate. Occasionally, information may contain an error or become outdated.

If an error materially affects an order, we will contact the customer and provide an appropriate option, which may include correcting the order or cancelling and refunding the affected payment.

ACCEPTABLE WEBSITE USE

You must not use our website:

• For unlawful or fraudulent purposes
• To interfere with the website’s security or operation
• To upload malicious code
• To impersonate another person
• To harass, threaten or abuse Baby Beaks, its representatives or other customers
• To copy or commercially exploit our content without permission

We may restrict access where these Terms are breached.

INTELLECTUAL PROPERTY

Unless otherwise stated, all website content, photographs, graphics, branding, written material and care resources created by Baby Beaks remain the property of Baby Beaks Redland Bay.

Content must not be copied, reproduced, sold, altered or used commercially without prior written permission.

PRIVACY

Personal information is handled in accordance with our Privacy Policy. By using our website or placing an order, you agree that we may collect and use the information reasonably necessary to process purchases, communicate with you and manage reservations or collection arrangements.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Baby Beaks is not responsible for indirect or consequential loss arising from website use, customer decisions, third-party services or circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or remedies that cannot lawfully be excluded under the Australian Consumer Law.

CHANGES TO THESE TERMS

We may update these Terms when our services, procedures or legal obligations change. The current version will be published on our website with its updated date.

Changes will not remove rights that have already arisen under Australian Consumer Law.

SEVERABILITY

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be read down or removed to the extent required. The remaining Terms will continue to apply.

GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia. Any dispute will be handled by the courts or tribunals with lawful jurisdiction in Queensland.
